Same-Sex Couples Face Jail Time If Married

With the option to obtain legal marriage licenses as of its June 17 legalization in California, many same-sex couples are making the journey despite laws in their home state. In Wisconsin, the pairs that attempt to obtain the certificate, which some have called "the missing piece of the puzzle" or the "the final part" to a family, are facing legal trouble with the state government and in many cases, jail time.
The state of Wisconsin imposes criminal penalties on residents if they enter a marriage outside the state that would be prohibited within state lines. The law was originally created in 1915 to prevent under age couples from crossing state lines to marry, but can, and will, be applied to same sex couples to attempt the same "crime."
Many couples acknowledge that jail time is at stake to obtain "outside recognition" of their union, and are willing to take that risk. The penalty for such actions could be a fine of up to $10,000, 9 months in jail or both. One lesbian couple notes, "We'd rather face prosecution than persecution."
